How to avoid illegal rental mediation fees in the Netherlands

These costs, often a month’s rent or more, can come as a shock. But here’s the thing: in most cases, they’re not legal!

Whether you’re relocating solo for a new job or moving your whole family across borders, understanding the rules around mediation fees could save you hundreds, if not thousands, of euros. Here’s what you need to know.

What are rental mediation fees?

Mediation fees are charges that rental agencies or housing intermediaries sometimes require you to pay for “helping” you find a rental home. They might be called:

  • Administration fees
  • Agency fees
  • Contract fees
  • Service costs
  • Commission
  • Intermediation fees


It all sounds fairly harmless… until you realise you’re being charged for something that may not be legally justified.

Are mediation fees allowed in the Netherlands?

The short answer? Not usually.

The long answer? Under Dutch law, a rental agent can’t charge both the tenant and the landlord. If the agent is representing the landlord (as is usually the case), they cannot charge the tenant mediation fees, even if they did help you arrange a viewing or sign a lease. That’s considered a conflict of interest, but it doesn’t mean that some agents don’t try to get away with it.

Here’s when fees are allowed:

  • If you hired the agent directly and gave them an exclusive search mandate
  • If the agent is clearly and only working for you, not the landlord

That’s a very rare situation. Most agents are paid by landlords, and still try to charge tenants, especially those new to the country who assume this is the norm.

Why this matters

If you’ve just moved to the Netherlands, or are preparing to, you’re likely under pressure, both in terms of time and money. The housing market is competitive, especially in cities like Amsterdam, Utrecht, The Hague, and Rotterdam. You might be applying for dozens of listings at once and just hoping to land one.

What to do if you’re asked to pay mediation fees

If a rental agent requests fees, ask the following:

  • Who do you represent as an agent: me or the landlord?
  • What exactly are these fees covering?
  • Are you aware of the Dutch rules around mediation fees

If they claim they work for the landlord but still demand payment from you, that’s a red flag. In many cases, you’re legally entitled to challenge the fee and may be able to claim it back through legal channels or Dutch tenant rights organizations, but if it sounds shady, you might want to avoid them in the first place.

Even just asking questions to show you know your stuff can be enough to make a seedy agent back down.

So… are these fees ever worth paying?

In rare cases, yes. If you’ve hired a reputable relocation specialist or rental agent who’s working exclusively on your behalf, the service might be worth the fee. Just make sure the agreement is clearly documented, and that you’re not unknowingly being charged for someone working both sides of the deal.
